Abstract

The “alleged flagrancy” has a period of twenty-four hours within which the members of the National Police of Peru (PNP) can arrest those involved without having a written order from the judge; Although it is true, the term for this type of flagrancy is interesting, compared to the very short time that entails a flagrancy “with his hands in the act” or the “quasi- flagrancy” that operates when the subject is followed and caught, This would not be sufficient for the development of one of the purposes that its members have, which according to Art. 166 of the Political Constitution of Peru (CPP, 1993) is to “prevent, combat and investigate crime.” The objective of this investigation was: To demonstrate that there is a significant relationship between the period of alleged flagrancy and impunity. Method: The level is descriptive – correlational; non-experimental design, cross-sectional and documentary analysis, the sample was 64 detectives to whom Likert-type surveys were applied. Result: The main result was that the current period of alleged flagrancy of 24 hours is directly related to impunity. Conclusion: A 72-hour period for alleged flagrancy could improve the effectiveness of investigations and reduce impunity in criminal cases.
