Abstract

The objective of this research is to theoretically reflect on the protection of fundamental human rights in the last Argentine civic-military dictatorship. To this end, an exhaustive analysis of the writ of habeas corpus was carried out, as a constitutional guarantee for the protection and freedom of movement of those who had been detained and "disappeared" in the latest state terrorism.

The topic in question is considered relevant because this year, specifically on October 30, 2024, 41 years will have passed since the recovery of the democratic regime in the Argentine Republic.
